NFALA Joins in Amicus Brief to
Support Constitutional Challenge on Arizona's Alien Land Laws
NFALA joined a coalition of leading civil rights scholars, legal advocates, and nonprofit organizations in the filing an amicus curiae brief on August 12, 2025 with the U.S. Court of Appeals for the Eighth Circuit in support of a constitutional challenge to Arkansas’s alien land laws—Act 636 and Act 174.
These laws, which restrict land ownership by so-called “foreign parties” or “foreign-party businesses,” have been criticized for discriminating on the basis of race and national origin and conflicting with federal immigration law.
The amicus brief supports the lawsuit Jones Eagle LLC v. Ward in which the plaintiff challenges
the enforcement of Arkansas’s alien land laws. The lawsuit was filed against the State of
Arkansas and several of its officials involved in implementing these laws. The case arose after the Arkansas Agriculture Secretary’s Office referred a U.S. citizen—originally from China—for investigation, alleging that his business violated the new foreign ownership laws. This referral occurred despite the business owner having submitted proof of his U.S. citizenship and
documentation of his company’s operations.

NFALA Joins NAPABA in Amicus Brief to
Defend Birthright Citizenship
The National Filipino American Lawyers Association (NFALA) joins the National Asian Pacific American Bar Association(NAPABA) and over 40 other affiliate bar associations from around the country in an amicus brief to defend the constitutional right to birthright citizenship.
The brief was filed in the United States Court of Appeals for the Ninth Circuit, in the case State of Washington, et al. v. Donald J. Trump, et al. (No. 25-807), on appeal from the United States District Court for the Western District of Washington.
This case concerns Executive Order 14160, which seeks to limit birthright citizenship in the United States to only the children of U.S. citizens and lawful permanent residents, excluding the children of legal visa-holders, asylum seekers, and undocumented immigrants, among other groups. Our amicus brief supports affirmance of the nationwide preliminary injunction issued by The Honorable John C. Coughenour, enjoining implementation and enforcement of EO 14160 on the basis that it violates the Citizenship Clause of the Fourteenth Amendment of the U.S. Constitution.
